Terms of Service

These Terms of Service (“TOS”) govern the use of all products and services provided by Done 5 Technologies Networks (“Done 5 Technologies”, “we”, “us”, or “our”). By ordering or using any service, you agree to comply fully with these Terms, our Acceptable Use Policy (AUP), and all applicable laws.

Failure to comply may result in suspension or termination of services without notice.

1. Service Agreement

Done 5 Technologies agrees to provide hosting and related digital services to the Customer, subject to full compliance with this TOS and our Acceptable Use Policy (AUP).

We reserve the right to:

  • Refuse service to any individual or entity at our sole discretion
  • Suspend or terminate any account that violates our policies
  • Determine what constitutes a violation of our TOS or AUP

All decisions made by Done 5 Technologies regarding policy enforcement are final.

2. Policy Changes

These Terms of Service and the AUP may be modified at any time without prior notice.

  • Continued use of services constitutes acceptance of updated policies
  • Policy changes do not qualify as grounds for early termination or non-payment

Pricing may change due to market conditions or hardware availability. Any change that affects your recurring billing will be communicated in advance.

3. Refund Policy

Refunds are limited and subject to strict conditions.

Eligible:

  • Hosting plans only
  • First service of a new customer
  • Requested within 25 days of account activation

Not Eligible:

  • Domains, SSL certificates, licenses, add-ons, or third-party services
  • Renewals, second accounts, or reactivated services
  • Accounts suspended or terminated due to TOS/AUP violations
  • Misconduct or abuse toward support staff

Refunds are only issued if the issue cannot be resolved by our technical team.

4. Account Suspension & Termination

Any violation of our policies may result in suspension or termination.

  • Suspended accounts may be reactivated by administrators
  • A 12-hour resolution window applies after reactivation
  • Repeated or unresolved violations will result in permanent termination

Administrator (root) accounts will not be disabled due to actions of end-users, but affected client accounts may be permanently removed.

5. Billing & Payments

  • Invoices are issued 10 days before the due date
  • Services must be cancelled before the due date to avoid billing
  • A 10% late fee applies after 5 days overdue
  • Services may be terminated after 20 days overdue

Excessive late payments may result in service denial or permanent termination.

6. Fraud & Abuse

Any form of fraud will result in immediate suspension or termination.

We reserve the right to:

  • Investigate all suspicious transactions
  • Report fraud to payment processors, banks, and legal authorities
  • Prosecute fraudulent activity to the fullest extent of the law

False chargebacks are considered fraud.

7. Chargebacks & Disputes

Initiating a chargeback or payment dispute without contacting us first will result in:

  • Immediate service suspension
  • A $100 USD chargeback fee

Fraudulent disputes will be treated as criminal activity.

8. Limitation of Liability

Done 5 Technologies is not liable for:

  • Service interruptions beyond our control
  • Data loss, revenue loss, or indirect damages

Our maximum liability shall not exceed the amount paid for services during the affected billing period.

9. Support Scope

  • Hardware support is included
  • Software support is provided only for fully managed services
  • We do not support third-party customers of our clients
  • Custom development or advanced configuration is available at additional cost

We are not responsible for data loss caused by misconfiguration or third-party scripts.

10. Data & Backups

  • Weekly backups are performed for emergency recovery only
  • Daily backups are not guaranteed
  • Customers are responsible for maintaining their own backups

We are not responsible for data loss due to accidental deletion, corruption, or failed backups.

11. Transfers & Migration

  • Free transfers available within 30 days of signup
  • Transfers are provided as a courtesy with no guarantees
  • Migration complexity varies between hosting providers
  • Transfers beyond 30 days may incur additional charges

We reserve the right to migrate services between data centers if required.

12. Resource Usage & Limits

Hosting accounts must be used for website hosting only.

  • File storage usage exceeding 70% for non-web purposes is prohibited
  • CPU usage limits apply to prevent service degradation
  • Accounts exceeding allocated resources may be suspended

Combining multiple plans to bypass limits is strictly prohibited.

13. Security & Network Abuse

Prohibited activities include:

  • Unauthorized access attempts
  • Port scanning, probing, or exploitation
  • DDoS attacks or service interference
  • Packet forging or email spoofing
  • Hosting illegal or malicious content

Violations may result in immediate termination and legal action.

14. IP Blacklisting & Spam

Any activity that results in IP blacklisting or spam abuse may lead to immediate suspension.

Reselling services to entities listed in spam databases such as Spamhaus is prohibited.

15. DMCA & Copyright Infringement

We take copyright violations seriously.

  • Infringing content will be removed immediately
  • Repeat offenders will be terminated
  • Counterfeit goods or pirated material is strictly prohibited

16. Payment Verification

We may request identity verification for security purposes, including:

  • Government-issued ID
  • Payment method verification
  • Card authorization documents

Failure to comply may result in service suspension.

17. Governing Authority

Done 5 Technologies Networks is the sole authority in interpreting and enforcing these Terms of Service.

By using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
